What a deed of variation does

A deed of variation records a change to a lease that both the landlord and the tenant have agreed. The rest of the lease stays as it is. You use one when you want to keep the existing lease but change part of it.

Common changes are:

  • a rent reduction or a new rent review method
  • extending or shortening the term
  • adding or removing part of the premises
  • changing the permitted use
  • adding a new option to renew
  • replacing or releasing a guarantor

A large change, such as a new term with new premises and new rent, may be better handled as a new lease. We tell you which suits your situation.

What we do

For the party preparing the deed, we draft it from the lease and the agreed changes. For the other party, we check the deed against the lease and tell you what it changes, what it leaves in place and anything you should ask for.

We also check whether:

  • guarantors need to sign
  • a mortgagee needs to consent
  • the deed must be registered on title
  • the change triggers your state’s retail leases Act, for example a new disclosure statement

If you are a tenant and the deed comes with a new lease, or you want the whole lease checked, we can review the lease at the same time.
